    I never said we should keep quiet about it. I was only responding to an earlier post reagarding 'EB2 - elitist protectionism'. Just like you are within your rights to look after yourself, so is everybody else - welcome to capitalism. I have always maintained that going down the road of EB3 versus EB2 is detrimental to this group. Your post only adds to this.

    In anycase I dont know how splitting visas equally between EB2I and EB3I can pass the smell test even if DOS were to implement it - there is a categorization that is already established AFTER the initial handout is made on an equal basis. The split completely negates it - at least to the extent any EB2ROW spill over is directed to EB3 when EB2 I and C are already retrogressed.

    Lets not swear by capitalism but selectively resort to socialism.

    Yes, you quoted Visa bulletin which says DOS "may" not to adhere to country limits in distributing spill overs .

    is there anything that says that distribution further has to be done in a particular way ??

    I have not found any . Probably there is none otherwise DOS could not have gotten away with "vertical" and "Horizontal" flip flops.

    In that light every comment about EB*->EB? , failing smell tests are speculative at best.

    You are yet to respond to my question of why EB3-I and recapture lobbying efforts cannot proceed simultaneously and How EB3-I lobbying undermines recapture effort.

    Good point, has anybody asked this to any lawyer ? Can we challenge this in court ? This is the definition of judiciary review...If we can proove the country cap to be unconstitutional..

    Judicial Review is when the Supreme Court reviews an act of Congress to see if it is Constitutional.
    Judicial Review is the power of the Supreme Court to declare a law unconstitutuion (violation against the laws of the Constitutuion).


    Anything that has language to exempt from quota is bound to run into severe resistance. However one thing here in US is to challenge any ambiguous negativity in courts. Has there been any instance of challenging country quota in the court as discrimination as some people brought it up earlier. Remember laws can also be changed through courts also, not just legislation.

    Even though we are far from Citizenship test, I know there are 3 branches of government,
    Judicial, Legislative and Executive.

    We do not seem to have much hope in the Legislative(Senate/House) and Executive(president) what are the chances of using that approach.

    I have recently been talking to members who have already filed I485 and have used AC21 to change jobs. I noted some limitations people face while changing jobs, getting higher salaries, making use of AC21 for changing more than 1 job.. etc etc.

    It seems there is lack of information on this subject. Let us use this thread to

    - share expeiences
    - List issues you have all faced so that IV can have this information while working on advocay efforts.
    - Make others aware of your problems and do's and don'ts in the community.
    - Interpretation of various lawyers on this and how they have helped you solve your difficult situations.

    i was feeling a lil down too for the last cupl of days...responding to some of those posters/reading their comments on alipac really brought me down.

    however i m feeling better now seeing the drama on immigration portal june visa bulletin thread...not that i am a drama monger.. but seeing drama between two professionals really spices things up.. why else are boxing and wwf interesting

    Does section 201 mean that those with advanced degrees from US Universities are exempt from the 3 year requirement? This clarification is critical because of the 3 years in the RELATED field clause. I do not believe any of the other bills incorporating similar provisions have made this distinction for US advanced degree holders vs advanced degree holders from other countries. I believe all other bills impose the 3 year RELATED field restriction for ALL advanced degree holders.

    If the 3 year RELATED field clause does not exist for US advanced degree holders in STEM, it would give relief to many members.

    Kindly clarify.

    same way you prove that in the case of I-140... by writing up letters exlaining job duties... and showing offer letter, pay stubs, company tax returns and/or quarterly tax receipts, client contracts... etc etc etc... again: what is your true point? why do you suspect that this is difficult?

    Its not ability to pay issue? The main point is to show that job is real, and bonafine.

    May I ask, how do you plan to demonstate that job offered in self employment is same/similar to I-140 job and it is bonafide job offer?

    I thought "Staying the course" was not an option anymore.. that's from the Iraq study group, democrats, and the president himself. Motto now "We need to change our tactics". :)

    Seriously I think we need to do the same and pursue the non-controversial goals first and then attempt the Home Run.

    If Microsoft with all the money and power can't get visa increase, it's naive to assume that we can do that in one shot. Let's just fry the small fish first.

    I forgot to say that I am going full speed ahead and staying the course.

    No one can realistically claim a moral high ground here - neither EB2 nor EB3. and that includes me too! Each one of us here are looking for self interest, period. No amount of calls to empathy/sympathy/solidarity will change that.

    For example, I'll get behind the whole "restore the old overflow logic for EB3" campaign in a heartbeat if we can have a consensus that EB3 will share the resulting overflow with EB3 other workers category too. EB3 other workers category is typically in worse shape than EB3-I so all the arguments presented here for EB3 (length of wait and frustration, unfairness of it all etc.) apply equally or more to the EB3 other workers. Any takers for this proposal?

    So please see all this for what it is and stop the endless debate. You can not realistically expect EB2s to support any campaign that directly harm their interests. EB3s of course have every right to run whatever campaign they wish but also accept that it *will* split active IV membership (rare as it is) along those lines vertically. That's why the calls to stick to "common minimum program" of visa re-capture. Only those campaigns that don't have conflict of interests will be able to draw whole IV membership behind them. It's human nature - plain and simple.

    Agreed. The resource(Visa numbers) is fixed and scarce. so it is natural that everyone will fight with whatever they can to access them , unless the resource is expanded (Recapture)

    EB3-I will be foolish to expect EB2-I's to help them out .

    IMO, IV has sensed this and maintained a dignified silence . They really cannot take a position on this and still function as objective forum .

    I think none of us should force them either ...IV has larger objective of increasing the pie and we should all support it.

    Where i disagree is why should EB3-I lobbying should split IV . I see no reason in that.
